This Online Privacy Policy applies to personal information that NorthAB, LLC, its subsidiaries and affiliated companies (“North,” “we,” “our,” “us”) may obtain when you visit www.north.com and/or the sites of North's subsidiaries or affiliated companies (the “Site” or “Sites”) that link to this Privacy Policy. This Privacy Policy describes how we may collect, use, or disclose information about you; your choices regarding our use of your information; how we safeguard such information; and how you may contact us regarding our privacy practices.

Collection of personal information.

Information you provide: We may obtain information that you provide directly to us when you interact with the Site(s) (e.g., when you fill out our contact form). This information may include personal information, which is information that can be used to identify you individually, such as your name, email address, and phone number.

Information collected automatically: We may collect certain information automatically using cookies and other online tracking technologies. The types of information we collect may include IP addresses, device identifiers, internet or other electronic network activity information, browser characteristics, operating system details, language preferences, referring URLs, length of visits, and pages viewed. These technologies may collect information such as IP address, screen size, device type (unique device identifiers), browser information, geographic location, and preferred language.

Some advertising vendors may participate in the Digital Advertising Alliance (“DAA”) and/or Network Advertising Initiative (“NAI”) and their opt-out programs. Records retention.

Except as otherwise permitted or required by applicable law or regulation, we retain personal information for as long as reasonably necessary to fulfill the purpose(s) for which it was collected, or for a disclosed purpose that is reasonably compatible with the context in which the personal information was collected. We retain personal information to provide services, manage our operations, comply with legal or regulatory requirements, or as may be reasonably required to protect or defend our rights or property.

Security.

We take reasonable measures to protect your personal information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. Nevertheless, transmission via the Internet and online digital storage are not completely secure and we cannot guarantee the security of your information collected through the Site(s).

Linked websites.

The Site(s) may include links to websites that are owned and/or operated by external parties. This Privacy Policy does not apply to those linked websites, which may have their own privacy policies or notices that you should review to understand how they may collect, use, or disclose your personal information. North is not responsible for the content or privacy practices of any such linked websites.

The Site(s) may also provide links to certain websites operated by North that, unless indicated otherwise, are not governed by this Privacy Policy. For information on how these websites may collect, use, or disclose your personal information, we encourage you to review the privacy policies posted on the linked websites.

Additional information for California residents.

This section provides supplemental information for California residents who may interact with North in certain specific circumstances where North acts as a “business” under the California Consumer Privacy Act (the “CCPA”).

Selling and sharing personal information

Under the CCPA, a “sale” of personal information may include disclosing personal information to third parties such as online tracking technology providers, and “sharing” personal information refers to disclosing personal information to third parties for cross-context behavioral advertising. In this respect, we may sell and share categories of personal information including identifiers, internet or other electronic network activity, geolocation data, and inferences through the use of online tracking technologies. We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age.

California privacy rights

Right to know. You have the right to know what personal information we have collected about you. This includes requesting information about the categories of personal information we have collected about you; the categories of sources from which the personal information was collected; our business or commercial purposes for collecting, selling, sharing, or disclosing personal information; the categories of recipients to which we disclose personal information; the categories of personal information we have sold or shared, and the categories of third parties to whom we sold/shared each category of personal information; and the categories of personal information that we disclosed for a business purpose, and the recipients of such personal information. This right also includes the right to ask about the specific pieces of personal information we have collected about you.

Right to delete. You have the right to request that we delete personal information we collected from you, subject to certain exceptions. Right to correct. If you believe that personal information we maintain about you is inaccurate, you have the right to request that we correct that information.

Right to opt out of sales and sharing of personal information. You have the right to opt out of the sale of your personal information and sharing of your personal information for cross-context behavioral advertising. As discussed above, you can opt out of sales and sharing of your personal information by clicking on the cookie icon at the bottom of any page on our Site(s). You also may exercise your right to opt out of sales, sharing, and targeted advertising via an opt-out preference signal such as Global Privacy Control (GPC). If you choose to use the GPC browser signal, you will need to enable it on each browser you use to access the Site(s).

We do not use or disclose sensitive personal information in a way that would trigger the CCPA's limitation rights, so the CCPA right to limit use and disclosure does not apply.

Submitting rights requests

California residents may email privacy@north.com to submit requests to know, delete, and/or correct the personal information we have collected about you. You may designate an authorized agent to make a request on your behalf. Before fulfilling a privacy rights request, we will take steps to verify the identity of the requestor. For example, we may ask you to provide additional information to confirm it matches our records.

We will respond to privacy rights requests in compliance with the requirements of the CCPA or other applicable law. We do not discriminate against individuals who seek to exercise their privacy rights under the CCPA.

Additional information for Texas residents.

This section provides supplemental information for Texas residents whose personal information may be processed by North in its capacity as a “controller” under the Texas Data Privacy and Security Act (the “TDPSA”).

Texas privacy rights

Right to access and data portability. You have the right to confirm whether we process your personal information, to request access to such personal information, and to request a portable copy of personal information you provided to us.

Right to delete. You have the right to request that we delete personal information we have obtained about you, subject to certain exceptions.

Right to correct. If you believe that personal information we maintain about you is inaccurate, you have the right to request that we correct that information.

Right to opt out of targeted advertising and sales of personal information. You have the right to opt out of the sale of your personal information and the processing of your personal information for targeted advertising. As discussed above, you can opt out of sales and targeted advertising by clicking on the cookie icon at the bottom of any page on our Site(s), or you may enable an opt-out preference signal such as Global Privacy Control (GPC) on each browser you use to access the Site(s). Note that we do not process personal information for purposes of “profiling” under the TDSPA.

Submitting rights requests

Information for users outside the United States.

If you are visiting the Site(s) from outside the United States, please be aware that information we obtain about you will be processed in the United States or in other jurisdictions. By using the Site(s), you acknowledge your personal information may be transferred to and processed in jurisdictions outside your own, as described in this Privacy Policy. Please be aware that the data protection laws and regulations that apply to your personal information transferred to the United States or other countries may be different from the laws in your country of residence.

Dispute resolution.

North seeks to resolve disputes amicably and efficiently, and many customer inquiries can be resolved by emailing Legal@North.com. In the unlikely event that a disagreement arises between you and North regarding, relating to, or connected in any way with your use of the Site(s) (a “Dispute”), you agree that, before initiating any legal action, you will first provide us written notice (a “Notice of Dispute”) via email at Legal@north.com so that we may work with you in good faith to find a mutually agreeable solution. Your Notice of Dispute must describe the nature and basis of the Dispute, and set forth the specific relief you are seeking.

During the sixty (60) days from the date we receive your Notice of Dispute, both parties agree to engage in good faith efforts to resolve the Dispute. During this 60-day period, both parties agree to toll any statutes of limitations that may apply, along with any filing deadlines.

We will consider reasonable requests to resolve a Dispute through alternative dispute resolution procedures, such as mediation or arbitration.

UNLESS OTHERWISE PROHIBITED BY APPLICABLE LAW, YOU WAIVE ANY RIGHT TO A JURY TRIAL AND YOU AGREE THAT ANY AND ALL DISPUTES (WHETHER BASED IN CONTRACT, STATUTE, TORT OR ANY OTHER THEORY) WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. ALL CLAIMS MUST BE BROUGHT SOLELY IN A PARTY'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, REPRESENTATIVE ACTION OR PROCEEDING.

To the fullest extent permitted by applicable law, you must assert any Dispute (by delivery of the Notice of Dispute) within one (1) year after the Dispute arises, or it will be forever barred.

Revisions.

This Privacy Policy is subject to change at our discretion. We will indicate changes, including material changes, to the Privacy Policy by updating the “Effective Date” at the top of this page. Your continued use of this Site, or Sites, after any update to this Privacy Policy will constitute your acceptance of the changes.
